Use of Services

Ez.com is meant to be used for personal and commercial use. It may not be associated with any illegal activities. Anyone clicking on a link powered by Ez.com or registering for an account agrees to these terms. Live Oak 360 Inc., its subsidiaries and affiliated companies, offer Live Oak 360 services to you, provided that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. In order to access certain services, you may be required to provide current, accurate identification, contact, and other information as part of the registration process and/or continued use of Live Oak 360 services. You are responsible for maintaining the confidentiality of your account password, and are responsible for all activities that occur under your account. You agree to immediately notify Live Oak 360 of any unauthorized use of your password or account or any other breach of security. Live Oak 360 cannot and will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep your password secure.

Appropriate Conduct

We will not tolerate the use of Ez.com in association with pornography, spam, unsolicited messages, or any illegal activities. If you are sending email in bulk with Ez.com links, you must have everyone give you direct permission to send them an email. You may be asked to send Ez.com a URL to where the users subscribed to your list. If you are sending email in bulk, your email list cannot be purchased or obtained through a third party. If you are sending in bulk, you must have a single-click unsubscribe link. If you have a question about these services, please contact us at support@Ez.com prior to publication of your Ez.com link. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content") are the sole responsibility of the person from which such Content originated and Ez.com is just a conduit to this material. Live Oak 360 reserves the right, but shall have no obligation, to pre-screen, flag, filter, refuse, modify or move any Content available via Live Oak 360 services. You understand that by using Ez.com services you may be exposed to Content that is offensive, indecent or objectionable, and that you use Ez.com services at your own risk. There are commercially available services and software to limit access to material that you may find objectionable.

Termination

Live Oak 360 reserves the right to terminate your account or any Ez.com at any time and without notification if we feel that our terms are being violated or if your account activity jeopardizes the integrity of the service. If you have a question about these services, please contact us at support@Ez.com prior to publication of your Ez.com link. You may discontinue your use of Ez.com services at any time. You agree that Live Oak 360 may at any time and for any reason, including a period of account inactivity, terminate your access to Ez.com services, terminate the Terms, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to Ez.com services, your account or any files or other content contained in your account.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT LIVE OAK 360 AND PARTNERS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF LIVE OAK 360 OR PARTNERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM: (i) THE USE OR THE INABILITY TO USE LIVE OAK 360 SERVICES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM LIVE OAK 360 SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON LIVE OAK 360 SERVICES; OR (v) ANY OTHER MATTER RELATING TO LIVE OAK 360 SERVICES.

Limitation of Damages

The amount of damages shall not exceed the amount paid to Live Oak 360, Inc.

You agree that Live Oak 360 may provide you with notices, including those regarding changes to the Terms of Use and Privacy Policy, by email or updates on Ez.com.
